Health Care Setback



But what about car insurance? We are required by law to have car insurance: is that now unconstitutional?

Neither are unconstitutional. However, requirements for car insurance are via state law, rather than federal law.

The Commerce Clause of the US Constitution most certainly allows Congress to pass this law. I personally don't favor fining people for not being able to pay health insurance, but the law is Constitutional.
